SMS & Text Messaging Policy

Last updated: November 6, 2026

This SMS & Text Messaging Policy describes how New Horizons Denver Primary Care ("we," "us," or "our") uses text messaging (SMS/MMS) to communicate with patients and prospective patients, and how we comply with the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations.

1. Scope

This policy applies to all SMS and MMS text messages sent by or on behalf of New Horizons Denver Primary Care, including appointment reminders, care-related notifications, health education messages, and any marketing or promotional communications.

2. Prior Express Written Consent (TCPA)

In compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and FCC regulations, we will only send you marketing or promotional text messages after obtaining your prior express written consent. This consent must:

  • Be obtained through a signed paper form, a web-based opt-in form, or another verifiable written method
  • Clearly disclose that you are agreeing to receive recurring automated marketing text messages from New Horizons Denver Primary Care
  • Include the phone number to which messages will be sent
  • State that consent is not a condition of receiving any healthcare services

For non-marketing communications — such as appointment reminders, prescription notifications, and care-related follow-ups — we may contact you at the phone number you provided during patient registration, consistent with applicable law and our HIPAA Notice of Privacy Practices.

3. How to Opt In

You may opt in to receive text messages from New Horizons Denver Primary Care by any of the following methods:

  • Completing and signing a consent form at our office during registration or at any visit
  • Submitting an opt-in request through our website contact form
  • Texting a designated keyword to our practice number, as instructed at the time of enrollment

By opting in, you confirm that you are the account holder or have the account holder's permission to enroll the phone number provided.

4. How to Opt Out

You may opt out of receiving text messages from us at any time using any of the following methods:

  • Reply STOP to any text message we send you
  • Email us at admin@newhorizonspc.com and request removal
  • Call our office and ask to be removed from our text messaging program

After opting out, you will receive one final confirmation message. No further marketing texts will be sent unless you choose to opt back in. Opting out of marketing texts does not affect appointment reminders or other non-marketing care communications you have separately consented to receive.

5. Message Frequency

Message frequency varies based on the type of communication:

  • Appointment reminders: Up to 2 messages per scheduled appointment
  • Care-related notifications: As needed based on your care plan
  • Marketing or informational messages: No more than 4 messages per month; exact frequency disclosed at opt-in

6. Message & Data Rates

Message and data rates may apply.

Standard message and data rates charged by your mobile carrier may apply to text messages you send or receive from us. These charges are determined by your individual mobile plan and carrier. New Horizons Denver Primary Care is not responsible for any charges incurred from your carrier. Contact your mobile carrier if you have questions about your plan's messaging rates.

7. Supported Carriers

Our text messaging service is available on most major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and others. Carrier availability may vary. New Horizons Denver Primary Care is not liable if your carrier does not support our messaging service or if messages are delayed or undelivered due to carrier issues.

8. HIPAA Notice

Text messages from New Horizons Denver Primary Care may contain limited health-related information such as appointment times or general care reminders. We take reasonable steps to protect the privacy of your health information in accordance with HIPAA. For full details, please request a copy of our HIPAA Notice of Privacy Practices at our office or contact us below.
